TERMS OF SERVICE

This Terms of Service ("Agreement") is entered into between Inservers Host Pvt. Ltd., operating under the brand name GBNODES.HOST ("GBNODES"), and the individual or entity ("Customer") purchasing or using GBNodes services. By purchasing, accessing, or using any GBNodes services, or by interacting with GBNodes' website or community, the Customer agrees to be bound by the terms set forth herein.

1. DEFINITIONS

1.1Customer – An individual who is at least 18 years of age or a legally recognized entity authorized to enter into contracts, purchasing services from GBNodes.

1.2Services – Game server hosting (including but not limited to Minecraft, GTA FiveM, ARK), related hosting infrastructure, and other ancillary services offered by GBNodes. Dedicated servers and VPS may be provisioned through GBNodes' sister brand, Inservers.host.

1.3Account – The Customer's registered profile with GBNodes, used to manage, access, and administer purchased services.

1.4Agreement – This Terms of Service document, along with all policies referenced herein, as amended from time to time.

1.5Fair Use Policy – Acceptable usage parameters and restrictions applicable to the Services as set out in Clause 6 of this Agreement.

2. ACCOUNT SETUP AND VERIFICATION

2.1The Customer shall provide complete, current, and accurate information when creating an account.

2.2GBNodes reserves the right to request identity verification, including but not limited to government-issued identification, before activating or continuing services.

2.3The Customer shall maintain the confidentiality of their account credentials and shall be solely responsible for any activity conducted through their account.

2.4GBNodes shall not be liable for any unauthorized access resulting from the Customer's failure to maintain account security.

3. SCOPE OF SERVICES

3.1GBNodes provides Services exclusively for lawful and fair use.

3.2Purchasing only a BungeeCord or proxy server without hosting at least fifty percent (50%) of the backend servers with GBNodes is prohibited.

3.3Violation of Clause 3.2 shall result in immediate termination of the relevant services without refund.

3.4All Services shall be subject to the Fair Use Policy in Clause 6.

4. REFUND AND CANCELLATION POLICY

4.1General Rule – Refunds shall be granted only where GBNodes fails to deliver the purchased service or where the service is materially non-functional due to GBNodes' fault.

4.2Non-Refundable Circumstances – Refunds shall not be provided in the following cases:

4.2.1Change of mind or dissatisfaction with service performance where the service is delivered as described;

4.2.2Violation of the Fair Use Policy or other provisions of this Agreement;

4.2.3Purchases made under discounts or promotions;

4.2.4Termination due to abuse, misuse, or illegal activity.

4.3Dedicated Servers and VPS – Provided under Inservers.host and subject to its refund policies.

4.4Refund requests must be submitted via GBNodes' official support system.

5. PAYMENT AND CHARGEBACK POLICY

5.1All fees must be paid in full before service activation.

5.2Late payments shall result in:

5.2.1Suspension of services after one (1) day;

5.2.2Permanent deletion of data after five (5) days;

5.2.3Application of late payment fees, if applicable.

5.3Initiating a payment chargeback or dispute is strictly prohibited.

5.4Any chargeback shall result in:

5.4.1Immediate suspension of all services;

5.4.2Termination of the Customer's account without refund;

5.4.3Legal action to recover the disputed amount, plus associated costs and legal fees.

6. FAIR USE AND ACCEPTABLE USE POLICY

6.1The Customer shall not engage in any activity that compromises the integrity, performance, or security of GBNodes' infrastructure or the experience of other customers.

6.2Prohibited Activities include but are not limited to:

6.2.1Hosting or distributing child sexual abuse material (CSAM);

6.2.2Engaging in hacking, phishing, identity theft, or fraudulent activity;

6.2.3Launching, participating in, or facilitating DDoS attacks;

6.2.4Running cryptocurrency mining operations;

6.2.5Port scanning, hosting spam/mass email servers, or botnets;

6.2.6Hosting pirated game files or copyrighted material without authorization;

6.2.7Running modifications, plugins, or software that cause node instability or security risks;

6.2.8Using services solely for proxy/BungeeCord purposes without hosting backend servers with GBNodes;

6.2.9Sustained high CPU or RAM usage detrimental to other customers;

6.2.10Storing files unrelated to the hosted game server (e.g., personal backups, large archives, unrelated media).

6.3GBNodes reserves the right to monitor service usage and take immediate remedial action, including suspension or termination without refund, if the Customer violates Clause 6.2.

7. DATA RESPONSIBILITY

7.1The Customer is solely responsible for creating and maintaining backups of their data.

7.2GBNodes may take operational backups but does not guarantee their availability, completeness, or integrity.

7.3GBNodes shall not be liable for any loss of data under any circumstances.

8. SERVICE AVAILABILITY

8.1GBNodes shall use commercially reasonable efforts to maintain continuous service availability.

8.2Downtime caused by maintenance, force majeure events, or the Customer's actions is excluded from any availability commitments.

9. SUPPORT POLICY

9.1GBNodes shall provide technical support limited to server-level hosting issues, including but not limited to network connectivity, hardware faults, and control panel access.

9.2GBNodes shall not provide support for:

9.2.1In-game administration;

9.2.2Plugin or modification installation or configuration;

9.2.3Gameplay assistance or troubleshooting.

9.3Support shall be provided exclusively through GBNodes' official communication channels.

10. DMCA AND CONTENT COMPLIANCE

10.1GBNodes complies with the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.

10.2Upon receipt of a valid DMCA notice, GBNodes may disable access to or remove the allegedly infringing material without prior notice to the Customer.

10.3Repeat violations may result in account termination without refund.

11. TERMINATION OF SERVICES

11.1GBNodes may suspend or terminate any service without refund if:

11.1.1The Customer violates this Agreement;

11.1.2The Customer engages in illegal activity or creates a security risk;

11.1.3Payment remains overdue beyond the grace period.

12. PROMOTIONS AND DISCOUNTS

12.1Promotions, discount codes, and offers are non-transferable and may not be reused unless explicitly permitted by GBNodes.

12.2GBNodes reserves the right to revoke or amend any promotional offer at its sole discretion.

13. INDEMNIFICATION

13.1The Customer shall indemnify, defend, and hold harmless GBNodes, its directors, employees, and affiliates from any claims, liabilities, damages, or expenses arising from:

13.1.1The Customer's use of the Services;

13.1.2Violation of this Agreement;

13.1.3Infringement of third-party rights.

14. LIMITATION OF LIABILITY

14.1GBNodes shall not be liable for any indirect, incidental, special, or consequential damages, including loss of data or profits.

14.2GBNodes' total liability shall not exceed the fees paid by the Customer for the affected service in the thirty (30) days preceding the claim.

15. GOVERNING LAW AND JURISDICTION

15.1This Agreement shall be governed by the laws of India.

15.2The courts of India shall have exclusive jurisdiction over any disputes arising under this Agreement.

16. MODIFICATIONS TO THE TERMS

16.1GBNodes reserves the right to amend this Agreement at any time.

16.2Continued use of the Services following the publication of changes constitutes the Customer's acceptance of the revised terms.
